1. Purpose
The Promotion of Access to Information Act, 2 of 2000 (PAIA), gives persons a right to request access to certain records held by private bodies where the statutory requirements are met. This page explains the MyMedGear process while our formal PAIA manual is being finalised and maintained in the prescribed format.
2. Records we may hold
Depending on the request and applicable retention periods, records may include company and governance records, customer and order records, supplier and service-provider records, finance and tax records, employment records, marketing records, website and technology records, policies and operational documentation.
3. How to make a request
A PAIA request should be made using the prescribed Form 2 and directed to the head of the private body or duly authorised Information Officer/Deputy Information Officer. Please contact us first through the Contact page or at sales@mymedgear.co.za so we can provide the correct submission details and assist with the process.
4. Information required
Your request should identify the record requested, provide sufficient information for us to locate it, explain the right you seek to exercise or protect where required, and include your contact details and preferred form of access. Identity or authority may need to be verified.
5. Fees
PAIA permits prescribed request and access fees in certain circumstances. If a fee is lawfully payable, we will notify you before processing proceeds where required.
6. Outcomes and refusals
Requests are assessed under PAIA. Access may be granted in full or in part, or refused where a statutory ground of refusal applies, including protection of privacy, confidential commercial information, safety, privileged information or other legally protected records. Reasons will be provided where required.
7. Personal information requests
If your request relates to your own personal information, our Privacy & POPIA Policy also applies. POPIA provides rights of access and correction alongside PAIA procedures.
8. Information Regulator
The Information Regulator oversees both POPIA and PAIA. Prescribed forms, guidance and complaint procedures are available from the Information Regulator.
9. Formal PAIA manual
We are aligning our formal private-body PAIA manual with the Information Regulator’s current template and requirements. The completed manual will contain the company’s confirmed registration details, head of private body / Information Officer details, categories of records, applicable legislation, request procedures and other prescribed information.
